Terms of Service

1. Who we are

discountpuffs.com (the “Site”) is operated by Discount Puffs LLC, a Florida limited liability company, d/b/a Discount Puffs (“we”, “us”, “our”). Contact: info@discountpuffs.com.

2. Age requirement — 21+

You must be at least 21 years old to access this Site or purchase from it. By using the Site you certify that you are 21 or older. We verify age at checkout, and all deliveries of vapor products require an adult (21+) signature. Providing false age information is a breach of these Terms and may violate federal and state law.

3. Products

Products sold on this Site contain or may contain nicotine, a highly addictive chemical, and are intended for adult smokers only. Hemp-derived products sold on this Site are intended to comply with the Agriculture Improvement Act of 2018 (the “Farm Bill”) and contain no more than 0.3% Delta-9 THC on a dry-weight basis. You are responsible for knowing whether a product is lawful where you live; we may refuse or cancel any order shipping to a jurisdiction where a product is restricted.

4. Orders, pricing, and acceptance

All orders are offers to purchase and are accepted only when shipped. We may cancel or refuse any order, including for age-verification failure, delivery address in a restricted state, pricing errors, or suspected fraud. Prices and availability may change without notice. Orders affected by obvious pricing errors will be cancelled and refunded.

5. Payment — including cryptocurrency

We accept the payment methods shown at checkout. For cryptocurrency payments:

• You must send the exact amount shown before the payment window expires.
• Blockchain transactions are irreversible — always double-check the address before sending.
• Orders are processed after network confirmation.
• Underpaid or late payments may be treated as failed; amounts received will be handled per our Refund & Return Policy.
• The advertised cryptocurrency discount applies to the product subtotal only.

6. Shipping restrictions (PACT Act)

Federal law (the Prevent All Cigarette Trafficking Act) regulates the shipment of vaping products. All vapor product shipments require age verification at purchase and an adult (21+) signature at delivery, and cannot be shipped through the U.S. Postal Service. Some states restrict or prohibit direct-to-consumer delivery of vapor products; see our Shipping Policy for the current list of excluded states.

7. Batteries and device safety

Lithium-ion batteries and vaping devices can be dangerous if misused. Never use damaged batteries, never carry loose batteries in a pocket or bag, use only appropriate chargers, and keep all devices and e-liquids away from children and pets. You assume all responsibility for the safe use, charging, and storage of products. Nicotine e-liquid may be poisonous if ingested or absorbed through the skin — if exposed, seek medical help immediately.

8. Prohibited use

You may not purchase products for resale or transfer to anyone under 21, use automated tools to purchase, misrepresent your identity or age, or use the Site for any unlawful purpose.

9. Disclaimers and limitation of liability

THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, AND OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS LIMITS RIGHTS THAT CANNOT BE LIMITED BY APPLICABLE LAW.

10. Dispute resolution; class action waiver

Any dispute arising out of these Terms or your purchase will be resolved by binding individual arbitration in Florida, and you and we each waive the right to a jury trial and to participate in a class action. Either party may instead bring an individual claim in small-claims court. You may opt out of this arbitration provision within 30 days of your first purchase by emailing info@discountpuffs.com with the subject “Arbitration Opt-Out.”

11. Governing law; changes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. We may update these Terms from time to time; material changes will be posted here with an updated “Last updated” date. Continued use of the Site after changes take effect constitutes acceptance.

12. SMS program

If you opt in to our SMS program: message frequency is up to 2 messages per month; message and data rates may apply; reply STOP to cancel (you will receive one confirmation message) or HELP for assistance; carriers are not liable for delayed or undelivered messages; consent to receive texts is not a condition of purchase. SMS opt-in data and consent are never shared with third parties for marketing.

Privacy Policy

What we collect

• Identity & contact: name, email, phone, billing and shipping address.
• Age verification: date of birth and the result of verification checks (required by law for age-restricted products).
• Order & payment: items purchased and payment details — for cryptocurrency payments this includes the transaction ID and the paying wallet address. Card processing, when offered, is handled by our payment processors; we never see or store full card numbers.
• Usage & device: IP address, browser type, pages visited, and cookies (see the Cookies Policy below).

How we use it

• To fulfill and ship orders, verify age (a legal obligation), and provide customer support.
• To send order updates, and marketing email/SMS only with your consent — unsubscribe or reply STOP at any time.
• To prevent fraud, keep records required by tax and PACT Act rules, and improve the Site.

Who we share it with

Service providers only, under contract, for hosting, payment processing, shipping, age verification, email/SMS delivery, and analytics. We do not sell your personal information and do not share it for cross-context behavioral advertising. We may disclose data when the law requires it, including PACT Act reporting to state tax administrators.

Retention and security

Order and tax records are kept as long as the law requires (at least four years under the PACT Act); marketing data is kept until you unsubscribe. We use commercially reasonable safeguards, but no method of transmission or storage is 100% secure.

Your California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have the right to: (1) know the categories and specific pieces of personal information we have collected about you; (2) request deletion; (3) request correction; and (4) opt out of the sale or sharing of personal information — note that we do not sell or share personal information as those terms are defined by the CPRA. We will never discriminate against you for exercising your rights.

Categories collected in the last 12 months: identifiers (name, email, address, IP), commercial information (orders), and internet activity (pages visited) — used only for the business purposes described above.

To submit a request, email info@discountpuffs.com with the subject “Privacy Request.” We verify identity before responding and respond within 45 days.

Your EU/UK Rights (GDPR)

If the GDPR applies to you, you have rights of access, rectification, erasure, restriction, portability, and objection, and may withdraw consent at any time. Our legal bases are: contract (processing your order), legal obligation (age and tax rules), legitimate interest (fraud prevention), and consent (marketing). Contact info@discountpuffs.com; you may also lodge a complaint with your local supervisory authority. Note that we ship only within the United States.

Age

This Site is for adults 21 and older. We do not knowingly collect information from anyone under 21; if we learn that we have, we delete it.

Cookies Policy

We use cookies — small text files stored by your browser — to run the Site. Session cookies keep you logged in and keep your cart working; preference cookies remember your settings (like age-gate confirmation); security cookies help prevent fraud; analytics cookies help us understand how the Site is used.
